The PSOE asks to urgently process the “Otegi law” while delaying the early retirement of police and civil guards to February

He has done it again. The PSOE has once again blocked the processing in Congress of the bill that would allow early retirement for national police and civil guards, as well as their recognition as a risky profession. There are already 18 occasions in which the Executive of Pedro Sánchez has requested extend the deadline for amendments to this rule to block and delay its approval. On this occasion until February 4, 2025.

A decision that, although not new, contrasts with the rush of the Executive to carry out another norm, the so-called “Otegui law” or “gag law”. And the socialists have formally asked process through the “urgent procedure” the reform of the Citizen Security Law agreed with EH Bilduwhich has caused so much indignation and discomfort among the State Security Forces and Bodies. A new blow to the agents, after the official report was released in which the Government assures that “the risky profession does not exist.”

It must be remembered that the fact of Belonging to a risky profession directly affects retirement. In what sense? Professionals grouped in the so-called risk professions have the option of requesting early retirement, collecting 100% of the benefit. In this way, the simple fact of not recognizing the members of the National Police and the Civil Guard as risk professionals greatly complicates their comparison with the rest of the regional and local police forces that are on that list.

Rush with the “gag law”

Controversy is also the new Citizen Security Law and that leaves agents “at the feet of horses”at a time when attacks on officers have skyrocketed. The various police unions and Civil Guard associations have stressed that this repeal occurs at a very negative time, with “demoralized and weakened personnel, in a scenario of aggravated violence and with a fragrant loss of the principle of authority“. And all this, before the impassive gaze of the Minister of the Interior, Fernando Grande-Marlaska.

Furthermore, they criticize the repeal of this law while the historical demands of the police and civil guards are turned away in salary matters, the equalization with the regional police, retirements and allowances; the working day or the right to strike among others. In his opinion, the modifications that are intended to be made to the Citizen Security Law “will directly harm police effectiveness, with the consequent lack of protection for society.”

Clash between the PNV and EH Bildu

After the amendments presented by PP and Vox against the repeal of the “gag law” did not go ahead, it is the turn of PNV and Junts. Specifically, Andoni Ortúzar’s people have presented 28 amendments to the Citizen Security Law and some of them that threaten to generate a clash with the agreement between the PSOE and Bildu.

The Basque nationalists are committed to touching part of the heart of the initiative of the socialists and the nationalist left by advocating for maintain disobedience and resistance to authority as a serious infraction and the manifest and clear refusal to identify oneself. And while it is true that his amendment almost entirely respects the text agreed upon by PSOE and EH Bildu, he rejects that this infraction can be considered minor, since it undermines “the principle of authority in police work.”

In addition, the Basque party also amends the new wording proposed by PSOE and EH Bildu for disrespect for authority. Specifically, the text proposed by the PNV rejects that sanctions for lack of respect become void if the author retracts since “if this absolution tool were approved, punishable acts could be carried out on a recurring and unpunished basis.”

For its part, Junts presented 17 amendments, many of them aimed at shield the powers of the Mossos d’Esquadra in matters of citizen security. In this sense, for example, in article 23, on the dissolution of meetings and demonstrations, Junts proposes specifying the “governmental authority” competent in matters of security, which in Catalonia is the Generalitat, a way to prevent them from taking action. the State Security Corps and Forces.
