The internal war that the Treasury technicians, grouped around Gestha, have declared within the Ministry and the Tax Agency (AEAT) is accentuated again, after they have denounced that the law of prevention of fiscal fraud continues to be breached and that the minister continues without complying with the European ratio as a number of experts dedicated to investigating the submerged economy. As they warn, to reach European figures it would be necessary to increase the workforce by 40%. A situation that from Gestha believes that it could be relieved rapidly «if the capacities of the body of technicians, which accumulate almost 84% of group A officials, but are excluded from the persecution of crimes against the public hacienda.
Gestha warns that the Anti -Fraud Law urged the Government to hire experts to estimate the submerged economy and increase the workforce to equate it to the EU average, so they accuse Montero that their inaction has caused the “collapse in 85% of the complaints for tax crimes, also omitting information in the results of recent years.” A decrease that “does not respond to a better fulfillment, but that the most complex and sophisticated frauds are persecuted.” In fact, the amount of fraud tax quotas has only declined 9.8%, so “evaders disappoint more, but they are denounced less.”
In this sense, they warn that the pending collection debt by the Tax Agency already amounts to 48,797 million euros as of December 31, 2024, which represents 16% more than the previous year. Therefore, the technicians accuse the Treasury of “traditionally use institutional marketing to show off every year a partial figures that mask a discreet global performance.” Although they recognize that “for the first time” the results of 2020 have been exceeded, they consider that they are “very discreet” figures, equivalent to a slight increase of 2.4% year -on -year in this period. They remember that the AEAT has published that in 2024 it achieved global results in the tax control of 18,928 million euros, compared to the results it reached in 2020 of 17,274 million euros, “year marked by confinement, the absence of visits to the business premises and the teleworking of the employees of the AEAT, despite which some results that have taken four years have been reached in Gestha
From the ministry directed by María Jesús Montero, they see the situation from an opposite prism. As explained to La Razón, complaints for tax crimes “are not omitted, they are systematically published in the agency’s memoirs. All are published on the web.” In addition, they remember that the reduction of complaints for fiscal crime about years of maximums “has to do with many external factors to the agency, among which are, for example, the crisis of the real estate sector, which caused many structures in the sector that were subject to complaint for fiscal crimes, they cease to exist or reduce.” They also insist that it also affects that “the approval at the time of anti -fraud measures, which eliminated concrete criminal mechanics.” In the same vein, they point out that the evolution of crimes is variable from one year to another, “because logically the complaints for crime depend on how the behaviors of the taxpayers and specific cases that may alter in one sense or another the historical series” are one year or another.
They also question the figures provided by Gestha. They insist that the 18,928 million euros of collection linked to the prevention and fight against fraud “represent 13% more than the previous year”; And if extraordinary files are discounted to obtain homogeneous results, “they are 4.3% more.” In the case of analyzing the direct income of control actions, “growth is 9.4% year -on -year.” They also explain that in the outstanding debt of collection, 5,000 million euros must be deducted because “they are fraudulently charged debts by third parties to taxpayers from the hydrocarbons sector, non -existent debts, ultimately”, so they deny that the debt rises that 16%, “just as it will not really descend the same at the end of 2025”.
The technicians insist on their complaints and point out that, “perhaps, aware of this atony, in April 2025 the AEAT increased the powers to the inspection technicians so that they can investigate companies of reduced dimension of up to 10 million euros, competencies that were without updating since 2014, eleven years despite the accumulated inflation at that time and the increase in the dimension of the companies.” Therefore, Gestha Vaticina an improvement in the results of the inspection of the coming years, and claims that this increase in competences reaches the areas of management, customs and collection.
