The “Angela de Miguel case” at the Board of Cepyme seems to have closed in false. Although it was decided to archive the investigation by the Internal Employers Committee on the alleged treatment of favor of the lawyers of their office in a public hiring, some business organizations continue to state that the case be reviewed.
De Miguel, an alternative candidate to Gerardo Cuerva in the next elections to the presidency of Cepyme, and that he has the support of CEOE and its president, Antonio Garamendi, seemed to have overcome this trance without a formal investigation had been opened, as confirmed to the reason sources of the organization. However, critical sectors in the employer of SMEs do not want these irregularities to be overlooked.
In this way, the president of the National Association of Administrative Managers, Fernando Santiago Ollero, has presented the President of the Committee, Pedro Fernández Alén, an official complaint about these facts and a formal request to clarify the reasons why the investigation in the first instance was rejected and that the denounced facts are analyzed. Specifically, they criticize that the decision to reject the alleged breach of the Ethical Code and good governance of Cepyme by De Miguel was not accompanied “of any explanation, analysis or motivation that allows us to understand what this conclusion has been based.”
In the same letter, he warns that “the worrying omission of the duty of diligence,” which corresponds to the Commission, “calls into the credibility of the control body and, even more, its institutional legitimacy”, so it requires that the investigation be reopened for “integrity and transparency to third parties. We must begin by complying and exemplarying our own internal rules ».
In his brief, Fernando Santiago attached a report prepared by his legal advice “in which they are always identified, always provisionally and in the event that the facts appeared in the media were certain, the possible crimes, infractions or breaches in which each part involved could have incurred.”
Within these infractions or crimes, he points out that Angela de Miguel could allegedly committed those of corruption among individuals – by granting an improper benefit to employees or collaborators of his company -; subsidies fraud – by using public funds without transparency–; influences – for using a position of power to its benefit – and a serious infraction of the Ethical Code and good governance of Cepyme.
The complaint filed by the president of the administrative managers has to do with facts that date back to 2018, when Miguel supposedly managed to appoint four of the five partners of his office, Nugotia Lawyers, as mediators of the Regional Labor Relations Service of Castilla y León (to be), a public entity attached to the social dialogue table of which she was part. A behavior that the Board of Cepyme has understood as “not constituting sanction or investigation”, something that has not convinced Fernando Santiago, so he has presented that request to Fernández Alén, of which he has not yet had an answer.
