The Madrid Prosecutor’s Office also refused to investigate the “obstruction” of the case against Pedro Sánchez’s brother

The Provincial Prosecutor’s Office of Madrid opposed the first instructor of the “PSOE sewers”, Arturo Zamarriego, expanding the object of investigation of his case to investigate the “maneuvers” against the Badajoz magistrate Beatriz Biedma, who sent the brother of the President of the Government to the dock, which would have been carried out by Leire Díez, the businessman Javier Pérez Dolset and the former judge expelled from the Carrera José Luis Sáenz from Tejada.

This is stated in a report that the Economic Crimes Section of the Madrid Prosecutor’s Office sent this August to the head of the Investigative Court number 9 of Madrid to defend the admissibility of inadmissing the complaint in which Manos Cleans asked to also investigate both the former socialist militant and Dolset and Sáenz de Tejada for actions aimed at accessing personal emails to discredit and question the judicial actions of the judge of the National Court Teresa Palacios.

In the case of the instructor of the “very brotherly case”, the union accused the three of having tried to “obstruct the procedure” in which David Sánchez was sentenced.

These actions of the alleged plot, stated the group of public officials, were aimed at “neutralizing judicial actions that could affect the PSOE.” And, for all this, in the complaint they were attributed crimes of obstruction of Justice, procedural fraud and revelation of secrets.

Well, the Public Ministry defended that from the “simple story” offered by Miguel Bernad’s union “it is deduced that there is no subjective or objective connection with the facts by which these preliminary proceedings are followed.”

The procedure that until just a week ago was instructed by Judge Zamarriego (before revoking himself in favor of Judge Santiago Pedraz, leaving the investigation unified in the National Court) was followed for illegal bribery and influence peddling only against the baptized “Ferraz plumber”, Pérez Dolset and the journalist Pere Rusiñol.

Based on this, the Prosecutor’s Office assured that it did not appreciate “similarity” between these events and those in which Clean Hands requested to investigate, nor that they were crimes “of the same nature”, nor did it deduce, “from all the concurrent circumstances”, that it could be useful for their clarification and the determination of responsibilities, to carry out a joint investigation of some and other actions allegedly carried out by the supposedly criminal network.

“Well, on the contrary, it could mean a delay for the procedure due to its breadth and complexity,” he indicated, in this sense, in the writing to which LA RAZÓN had access.

The prosecutor who was in charge of the now-extinct judicial process recalled that it focused solely on the offers made by Díez, Dolset and Rusiñol to two former Anticorruption prosecutors, Ignacio Stampa and José Grinda.

As well as in a series of meetings in which it was intended to obtain negative information about judges (such as retired magistrate Manuel García-Castellón) and prosecutors (in addition to Grinda, from the Chief Anti-Corruption Prosecutor, Alejandro Luzón) “to negatively influence their professional actions.”

The representative of the Public Ministry also stressed that “everything related to insults, slander and revelation of secrets that were reported in Badajoz” had already been excluded.

The complaint was filed on June 16 by Manos Liminas in the Plaza de Castilla courts (Madrid) in order to appear as part of the popular accusation, after the instructor denied, first, his appearance as an injured party to exercise the private accusation.

In the complaint they stated, based on published journalistic information, that “the sewers could have accessed in an unauthorized manner to email accounts owned” by Bernad’s union “with the purpose of collecting their internal information, possibly intended to obtain elements with which to question their procedural actions in the criminal proceedings carried out in Badajoz in relation to David Sánchez, with the consequent purpose of hindering the correct administration of Justice.”

On the other hand, in another document issued on the same date, the Madrid Prosecutor’s Office requested the dismissal of the appeal for reform (subsidiary appeal before the Provincial Court of Madrid) that Manos Limbas filed against Judge Zamarriego’s decision to reject his appearance, which took place on June 10.
