This is the new sick leave due to menopause and gender violence: who can benefit and how much is charged

Temporary disability will have two new special cases. One will cover the women with limiting pathologies associated with a menopausal disorder that prevent them from working; the other, to female workers who are victims of gender violence whose injuries do not allow them to carry out their activity. The Council of Ministers has approved the measure through a Royal Decree-Law.

It is not an automatic discharge due to menopause

The new protection will not be applied for the mere fact of going through menopause or for any symptom. To benefit from it, it will be necessary for there to be a pathology associated with menopausal disorderwith disabling symptoms that prevent work and a diagnosis identified with the specific coding provided for this situation.

The second case is aimed at working women who are victims of gender violence when the injuries resulting from this violence prevent them from working. In both cases, the leave must respond to a medical situation that affects work capacity.

How much is charged during sick leave

The benefit will be calculated on the regulatory base, This is 60% until the 20th day of withdrawal and 75% from the 21st. A minimum prior contribution period will not be required to access this special protection.

The company will pay the salary corresponding to the first day. From the following day, payment of the benefit will be borne by Social Security. The change prevents these workers from being left without benefits during the first days, as happens in temporary disability due to common contingencies.

This Tuesday, the Government approved the Royal Decree-Law that includes the measures. The specific date of application will depend on what the text establishes when it is published in the Official State Gazette.
